ESS New Build Definition

Activities are ineligible if undertaken to comply with National Building Standards, BASIX or if works exceed $50,000.

May 2026 DCCEEW further clarifiied new builds under D16 rules following published responses to consultation here: https://www.nsw.gov.au/sites/default/files/noindex/2026-02/ess-and-pdrs-rules-faqs.pdf

Installations and renovations (>$50,000) that are built to comply with National Building Standards or BASIX are inelligible under the ESS / PDRS.

Further email correspondence with DCCEW narrowed down an elligibilty timeline of 12 months post build "Premesis must not have been constructed at least 12 months prior to the activity date".
